  • Joint Tenants

    Joint tenancy and tenancy in common are most common forms of co-ownership in Canada. The main difference is that joint tenancy provides the right to survivorship. Under Joint Tenancy when one tenant dies their interest in that property ceases to exist, and the right of survivorship automatically transfers the deceased tenant's interest to all the survivors remaining on the title as joint tenants. Under joint tenancy, a tenant cannot transfer their interest to another in their will. Co-owners in a joint tenancy hold an undivided interest the entirety of the property. In other words, the property cannot be divided or subdivided; it is to remain as a whole. Each tenant holds an equal interest in the property, for example, two owners have a ½ interest each, three owners have a 1/3 interest each. Amongst themselves, joint tenants have separate rights, but against others, they are a singular legal owner.
  • Tenants in Common

    With tenancy in common, owners own a separate share in the property. Shares in the property can be disproportionate, for example, one owner can own 2/3 and the other 1/3, often this is proportionate to the amount each owner invests in the purchase of the property. An owner can sell their share, and the prospective buyer would then become a new tenant in common. Unlike joint tenancy, tenants in common may leave their share to another person via a will. However, if a tenant in common dies without a will, their share passes as part of their estate.
